Terms of Use

These terms govern your use of the Birth Companion mobile application, contraction timer, breathing guidance, and subscription features.

Crucial Medical Notice • Apple App Store Guideline 1.4.1 Compliant Birth Companion is strictly an informational and comfort application. It is NOT a medical device and does NOT offer medical advice, clinical diagnosis, or patient monitoring. Always seek the direct guidance of your physician, midwife, or qualified healthcare provider with any questions regarding labor progression or medical conditions.

1. Acceptance of Terms

By downloading, installing, accessing, or using Birth Companion (“the App”), you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree with any part of these terms, do not install or use the App.

Section 2

2. Description of the Service

Birth Companion is created to assist expectant parents and their birth partners through labor and preparation by offering:

  • Contraction (Wave) Timing: Manual recording of contraction start times, end times, intervals, and subjective intensity reflections.
  • Personal Wave Log: Review and PDF export of logged contraction sessions for sharing with care providers.
  • Breathing Guide: Visual breathing pacing and optional haptic feedback.
  • Apple Watch & Live Activities: Companion timing on a paired Apple Watch and a visible timer on the iPhone Lock Screen.

We grant you a revocable, non-exclusive, non-transferable, personal license to use the App on compatible Apple devices that you own or control.

3. Critical Medical & Emergency Disclaimer

3.1 Not a Medical Device: Birth Companion is not intended for use in the diagnosis of disease or other conditions, or in the cure, mitigation, treatment, or prevention of disease or pregnancy complications. It has not been cleared, certified, or approved by the US FDA, EMA, or any other medical regulatory agency.

3.2 Never Disregard Professional Advice: The informational metrics, interval estimations, breathing prompts, and affirmations provided in the App are intended solely for relaxation and personal record-keeping. You should never disregard professional medical advice, delay seeking it, or make clinical decisions regarding hospital admission based on information contained in or computed by the App.

Emergency Situations: If you experience heavy vaginal bleeding, sudden leakage of fluid (broken waters), continuous severe abdominal pain, a noticeable decrease in fetal movements, high fever, or feel unwell, immediately call your local emergency services using the number for your location, such as 112 or 911. Do not wait for the app to assess your condition.

4. Subscriptions & In-App Purchases

The first 10 completed contraction recordings include access to all features in this version. These free recordings do not require a subscription and do not start automatic billing. After the tenth recording, a weekly or monthly auto-renewing subscription is required for new recordings and other gated features on iPhone and Apple Watch. The journal, editing, individual deletion, and PDF export remain available without a subscription. Deleting journal entries does not reset the free-recording counter. A subscription unlocks the features available in the current version; it is not a purchase of promised future AI, voice, or sound features.

  • Billing: Payment is billed through your Apple ID account at confirmation of purchase via Apple App Store.
  • Auto-Renewal: Subscriptions automatically renew unless auto-renew is canceled at least 24 hours prior to the conclusion of the current billing cycle.
  • Price and renewal: The selected plan’s localized price and billing period are displayed before purchase. Apple charges for renewal within the 24 hours before the current period ends. Canceling stops future renewals; access normally continues through the paid period. Deleting the app does not cancel the subscription.
  • Managing Subscriptions: You can manage, modify, or cancel your subscription at any time in your iPhone/iPad Settings (Settings → Apple ID → Subscriptions → Birth Companion).
  • Refunds: All payments and refunds are governed strictly by Apple App Store policies. To submit a refund request, visit reportaproblem.apple.com.

5. Acceptable Use & Conduct

You agree to use Birth Companion only for lawful purposes. You shall not:

  • Attempt to decompile, reverse-engineer, disassemble, or derive the source code of the App.
  • Circumvent or tamper with technical usage limitations or entitlement mechanisms.
  • Resell, lease, rent, or distribute the App to third parties.

6. Intellectual Property

All intellectual property rights in Birth Companion, including its software architecture, visual interface, artwork, audio recordings, written content, trademarks, and branding, are owned exclusively by us or our licensors. All rights not expressly granted to you are reserved.

7. Availability & Modifications

We strive to keep Birth Companion reliable and available. However, we reserve the right to modify, update, enhance, or temporarily suspend features for maintenance. We do not warrant that the App will function uninterrupted or error-free in every environment or on every device configuration.

8. Disclaimer of Warranties & Limitation of Liability

To the maximum extent permitted by applicable law, Birth Companion is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express, statutory, or implied.

In no event shall the developers, contributors, or distributors of Birth Companion be liable for any indirect, incidental, special, consequential, or punitive damages—including but not limited to loss of data, personal inconvenience, or medical complications—arising out of or related to your use of or inability to use the App.

9. Governing Law & Contact
